My Life and Wishes, Inc. (“MLW”, “we”, “our” or “us”) is committed to simplifying details and matters for your loved ones following your passing. We understand the importance of safeguarding your Personal Information (defined below), and treating such information with security and respect. We understand the need to feel safe when sharing information with third parties, and we have developed this Privacy Policy to help you understand our practices.

Our Privacy Policy describes how MLW collects, uses, processes and discloses your information on www.mylifeandwishes.com (the “Site”) and the products, services, mobile websites, and native mobile applications (collectively and together with the Site, the “Services”). By using the Site and the Services, and in particular when you enter information into your account on MLW, you agree to the terms of this Privacy Policy and the collection, storage, use, processing and disclosure by My Life and Wishes, Inc. and its services providers of the Personal Information that you enter into the Services. If you don’t agree with this Privacy Policy or the Terms of Service (Terms and Conditions), please do not use the Services.

Personal Information
Personal Information means any information that uniquely identifies you or any other individual or otherwise contains personally identifiable information provided by or obtained from you or any other user of the Services. Personal Information may include certain types of Basic Information, Secure Information, Designated Viewer, End of Life Information, Access Code Information and Public Information, each of which is described in further detail below. MLW does not share Personal Information with any third party other than as described in this Privacy Policy.

Basic Information
Basic Information means your name, address, email address, date of birth, age, gender and the date and time of your account creation and (if applicable) deletion. We may use our Basic Information to contact you to send you information about the Services. If you don’t want to receive email communications from us, follow the “unsubscribe” instructions at the bottom of any email message you receive from us. There are certain types of important email communications that we need to always be able to send to you (such as notifications about password changes or changes to the Terms of Service or this Privacy Policy) for which you may not be given an “unsubscribe” option.

Secure Information
Secure Information means your private, sensitive, personal information that you privately enter through MLW Services, including your final wishes, health and medical information, financial information, family information and legal information. While we may know whether and when you submitted a particular type or category of Secure Information, we do not in the course of our standard daily business operations have access to the content or details of any Secure Information you privately submit through the Services because it is encrypted. Your Secure Information can only be shared with your Co-Owner and Authorized Viewer (as defined below) and only pursuant to your explicit instruction, except when we are required to by law or in other rare circumstances, as described below.

Co-Owner/Authorized User
Co-Owner and Authorized User means the name, email address, personal information and other contact information of the person you choose to share your Secure Information with, in whole or in part, through the MLW Services. We use this information to deliver and administer the Services only in accordance with your specific instructions.

End of Life Information
End of Life Information means the name of the person who is recently deceased, their final wishes and for whom you are organizing or otherwise facilitating the final wishes of the deceased and the names, email addresses and other contact information of any Authorized Viewers who are authorized to access your account. We use End of Life Information to deliver and administer the Services only in accordance with your specific instructions.

Access Information
Access Information means certain high-level information about your use of and access to the MLW Services that may be visible to Authorized Users. This may include the type of MLW Account you signed up for, the date and time of your last login to the MLW Services, your total number of logins to the Services, and which sections of your MLW you completed and are visible to your Authorized Users.

Public Information
Public Information means any personally identifying information you post in any public forum through the Services (e.g., in the comments section below articles, blogs, communities etc.). Please remember that any Public Information you post publicly on the Services is not private, and thus may be used or disclosed by any third party who reads such Public Information without our control and without your knowledge, and search engines may index that information. Accordingly, please think carefully before publicly posting any Public Information on the Services.

Non-Personal Information
In contrast to Personal Information, “Non-Personal Information” does not, on its own, uniquely identify you or anyone else as a specific individual, but rather provides technical data, such as information about your interaction with the Services or about your browser. Non-Personal Information may include Aggregate Information, and Cookie Information, each of which is described in further detail below.

Aggregate Information
Aggregate Information means statistical information about how, how often, and when you use the Services and your demographic information. We may use Aggregate Information in order to understand how and how often people use the Services, which in turn allows us to improve them, but never in a way that is personally identifiable.

Cookie Information
Cookies are small text files that are stored by a user’s web browser on the hard drive of a user’s computer. Cookies can “remember” what information (“Cookie Information”) a user accesses on a particular web page to simplify subsequent interactions with that website by the same user, or cookies can use that information to streamline the user’s transactions on related websites. The cookies we use on our Site may be “session” cookies that are erased when you leave the Site, or they may be “persistent” cookies that remain on your computer’s hard drive after you leave the Site. We also use a cookie installed by Google, Inc. to provide us with usage information regarding the Site. The cookies we use do not capture your Personal Information. We may also set cookies when you register at the Site, and may do so without notice to or permission from you or any third party. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our Site, but features or areas of our Site may not function properly.

We use Google AdWords Remarketing to advertise across the Internet. AdWords remarketing will display relevant ads tailored to you based on what parts of the My Life & Wishes website you have viewed by placing a cookie on your machine. THIS COOKIE DOES NOT IN ANYWAY IDENTIFY YOU OR GIVE ACCESS TO YOUR COMPUTER. The cookie is used to say, “This person visited this page, so show them ads relating to that page.” Google AdWords Remarketing allows us to tailor our marketing to better suit your needs and only display ads that are relevant to you.” Users can opt out of Google’s use of cookies by visiting Google’s Ads Settings.

Information MLW Typically Does Not Collect
While we may charge a fee now or in the future for use of certain aspects of our Services (the “Premium Services”), your valid credit card number, type, expiration date, name and billing address (collectively, “Payment Information”) is collected, stored, used and processed by Authorize.net, our third party payment processing company, and not by us. Accordingly, the collection, storage, use and processing of your Payment Information is governed by Authorize.net applicable terms of service available at www.authorize.net/company/terms/and privacy policy available at www.authorize.net/company/privacy/ However, sometimes we may request and receive some of your Payment Information from Authorize.net in order to complete certain transactions you initiated through the Services, to enroll you in a discount or other rebate program you elected to participate in, to protect against or identify potentially fraudulent transactions, or otherwise as necessary to manage our business. Accordingly, sometimes we may obtain Payment Information pertaining to you as a result of your use of the Services; but, you can rest assured that we will only use any such Payment Information we obtain in furtherance of the Services.

How We Use or Share Information
We will share your Secure Information only with your Co-Owner and Authorized Users and only pursuant to and in accordance with your explicit instruction. This includes the permissions you set that give any particular Co-Owner or Authorized User access to all or certain designated portions of your MLW Account.

We may share certain of your Personal Information with certain partners or service providers we use to perform, facilitate or improve the Services (collectively, “Agents”), but only in order for MLW to be able to provide you the Services. All of our Agents are contractually bound to protect the confidentiality of your Personal Information.

We may also share non-personal Aggregate Information with our Agents so that they understand how and how often people use our Services and their services, which in turn allows both us and them to improve.

If MLW at some point is involved in a merger, acquisition, sale, reorganization, liquidation or other disposition of all or substantially all of its assets to another entity (the “Acquirer”), you will be notified via email and/or a prominent notice on our Site of any such change in ownership and of the choices available to you with respect to your Personal Information. Remember, you can always choose to export and delete your Secure Information from the Services. The Acquirer will possess your Basic Information and any other Personal Information you do not delete from the Services (which may include part or all of your Secure Information) and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.

Sharing Pursuant to Applicable Law
Other than sharing with Co-Owners, Authorized Users or Acquirers as described above, we can only share Personal Information, including your Secure Information, in the limited circumstances described below relating to your abuse or misuse of the Services or legal process.

If we believe that you have misused or abused the Services or the Personal Information of any other user, or have attempted to interfere with or harm the Services, we will investigate and cooperate with appropriate law enforcement officials, which may include sharing your Basic Information with them in order to protect our rights or property or that of other users, Co-Owners and Authorized Users. We will give our full cooperation in any legal process or criminal investigation into any misuse or abuse of the Services.

We may also share your Personal Information solely to the extent required by law to comply with a subpoena or analogous legal process or governmental request; while this may include certain of your Secure Information, rest assured that we will never willingly share any of your Secure Information unless required by law. We may also share your Personal Information as otherwise necessary to protect our rights or property or that of other users, Co-Owners and Authorized Users.

We will promptly notify you if we receive any request for your Personal Information or Secure Information from any governmental entity or other third party pursuant to a subpoena or analogous legal process before sharing any such requested information, unless we are legally prohibited from so notifying you or we have a good faith reason to believe that such sharing is or may be necessary to protect someone’s life, avoid serious physical injury or property loss or damage, or to prevent or investigate any ongoing crime.

As discussed in the Terms at www.mylifeandwishes.com/terms, no fiduciary duty is or will ever be created between you and MLW by virtue of you using the Services. Accordingly, while communications between you and us are protected in accordance with this Privacy Policy, they are not protected by the physician-patient privilege, doctor-patient confidentiality, attorney-client privilege, work product doctrine, or any other fiduciary duty.

Security
The security, privacy and confidentiality of your Personal Information is of utmost and critical importance to us, which is why we have implemented a variety of industry standard (or better) administrative, physical and technical protections to safeguard the security, privacy, confidentiality and integrity of your Personal Information, including without limitation your Secure Information.

We implement end-to-end encryption, ensuring your data is encrypted through all points it travels, from your web browser, to our servers, and to all the places it is stored and backed up for redundancy. From the moment you start using the application, your data is encrypted as you send it to us using SHA 256 encryption and 2048 bits of encryption power, equivalent to a number that is 617 digits long. Your encrypted personal data is even encrypted again when it is stored and transmitted between systems, and only retrieved when you need it.
Your password is encrypted and stored in an irreversible way. We use industry recommended best practices to ensure your password is stored in a way that is challenging, to say the least, to figure out. Someone would have to spend a lot of time and money to reverse engineer your password by guessing all the possible passwords and then hashing each of them in hundreds of ways to figure it out. Be sure to pick a good password to ensure you make it even more challenging for someone to guess it.
Two-Step Authentication is strongly encouraged (but not required) of all users, Co-Owners and Authorized Viewers.
Our technology uses AES 256 encryption, the same quality relied on by banks, the military and the U.S. government. Your data is uniquely encrypted for you and those that you choose to share it with.
Your Secure Information is encrypted and stored in a hosting provider that has 24/7 physical and biometric protections, firewalls, intrusion detection systems, and an array of other technological safeguards and 24 different security certifications.

While no website operator can guarantee that its security measures or safeguards will be 100% effective, and MLW cannot guarantee absolute security of any of your Personal Information, including without limitation your Secure Information. MLW SHALL NOT BE RESPONSIBLE OR LIABLE FOR UNAUTHORIZED ACCESS, HACKING OR OTHER SECURITY INTRUSIONS OR FAILURE TO STORE OR THE THEFT, DELETION, CORRUPTION, DESTRUCTION, DAMAGE, OR LOSS OF ANY DATA OR INFORMATION, INCLUDING WITHOUT LIMITATION SECURE INFORMATION.

If we discover a security incident that compromises your Secure Information, we will let you know about it in accordance with applicable law. Please notify us immediately of any suspected or unauthorized use of your password or account or any other such incident by contacting us at support@mylifeandwishes.com

Special Notice to California Customers
If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your Personal Information to third parties for the third parties’ direct marketing purposes. We may share your Personal Information with our affiliates for direct marketing, but we do not sell it to or share it with unaffiliated third parties. You may request a list of our affiliates by contacting us at My Life and Wishes, Attn: Marketing, 5520 Nobel Drive, Suite 150, Fitchburg, WI 53711. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. Please allow up to thirty (30) days for a response.

Social Media
Our Site may include Social Media Features, such as the Facebook Like button and widgets, such as the “Share this” button or interactive mini-programs that run on our Site. These features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the feature to function properly and for other purposes. Social Media Features and Widgets are displayed on our Site, but are hosted by the third party identified in the widget. These Social Media Features and Widgets are subject to their own privacy policies, not this one, and their privacy practices may differ from those on this Site.

Deleting your MLW account
For customer’s who wish to discontinue their MLW Service, you may do so from within your MLW account, which you can access by logging into your account here: https://mylifeandwishes.com/signin and clicking “my account” followed by “account settings,” where you will find a “Delete My Account” option. If you have trouble, please contact us customer service at 1-844-369-4747 for assistance. When you delete your account, all of your Secure Information will be deleted. Please note that we may keep your Non-Personal Information and any of your Personal Information other than your Secure Information even after your account deletion.

Modifications
WE MAY MODIFY OUR POLICY FROM TIME TO TIME. WE WILL POST THOSE MODIFICATIONS OF OUR WEBSITE PRIOR TO THE MODIFICATIONS BECOMING EFFECTIVE. WE WILL NOTIFY YOU OF MATERIAL MODIFICATIONS TO THIS PRIVACY POLICY, INCLUDING BY SENDING YOU A COPY OF THE UPDATED POLICY BY EMAIL IF WE HAVE YOUR EMAIL ADDRESS ON FILE, PRIOR TO THE CHANGE BECOMING EFFECTIVE. YOUR CONTINUED USE OF THE SITE OR OUR SERVICES AFTER ANY SUCH MODIFICATION MEANS THAT YOU ACCEPT THE MODIFIED POLICY. EACH TIME YOU USE THE SITE, THE LATEST VERSION OF THE POLICY WILL BE DISPLAYED AND WILL APPLY.
